A federal judge today struck down Kentucky's ban on recognizing marriages for same-sex couples performed in other jurisdictions. U.S. District Judge John G. Heyburn II said the ban violates the U.S. Constitution's guarantee to equal protection under the law. Heyburn cited the historic 2013 Supreme Court ruling on the so-called "Defense of Marriage Act" while striking down the portion of Kentucky's 2004 constitutional amendment that said, “only a marriage between one man and one woman shall be valid or recognized as a marriage in Kentucky.”
The suit was originally filed by several same-sex couples, including Gregory Bourke and Michael Deleon, who married in Canada in 2004. GLAAD previously worked with Bourke to end the Boy Scouts of America's ban on gay youth.
