Texas judge upholds the unconstitutionality of state's marriage equality ban

A federal judge ruled Texas' ban on marriage equality is unconstitutional this past February and stayed his ruling pending an appeal. Now a state judge has issued the same ruling. It permits a San Antonio couple to move forward with their divorce and child custody case. Texas Attorney General Greg Abbott is appealing the February ruling.

In a move that follows suit with a federal ruling issued in February, a state district judge has deemed Texas' restrictions on same-sex marriage unconstitutional - paving the way for a San Antonio couple's divorce proceedings and subsequent child custody battle to continue.
